1. Preparation of Documents

The process starts with collection and up-dating the required documents for Power of Attorney. The requirement is prescribed by the government and changes from time to time. However, currently the following documents are required to register a Power of Attorney deed from USA via the embassy of Bangladesh.         

(A) Documents for MoHPW, NHA and RajUK Power of Attorney

  • Allotment letter
  • Possession letter
  • Lease deed/ Lease Agreement
  • Title deed (If became owner by purchase or gift)
  • Via deed(s) (if any) and Sale permission
  • Mutation Permission ( RajUK, MoHPW, NHA)
  • Warishan sanad issued by UP or City Corp. (if any)
  • Succession certificate from Court (if any)
  • AC Land Mutation (Up-to-date Khajna, DCR), and Mutation proposal and Mutation Khatiyan).
  • Photo, NID/Passport, TIN and TAX return of the Land Owner and power receiver.

(B) Documents for freehold or private land Power of Attorney

  • Title deed (If became owner by purchase or gift)
  • Via deed(s) (if any)
  • Khatiyan (CS, SA, RS, City/BS)
  • Warishan sanad issued by UP or City Corp. (if any)
  • Succession certificate from Court (if any)

2. Draft the Power of Attorney Deed (in Bangladeshi Format)

A properly formatted deed is the pre-requisite of land registration in Bangladesh. This format is prescribed by the government and change time to time. 3. Attestation at Bangladesh Embassy

Once a power of attorney deed is drafted and printed on the stamp paper, it will be sent to the power maker at USA. The POA will enclose the supporting documents in serial. The principle then shall visit the nearest Bangladesh Embassy or High Commission. For example, Bangladesh Embassy in Washington DC, or Bangladesh High Commission in New York subject to a prior appointment. Following formalities are required at the embassy.

4. Courier to Bangladesh

As soon as the attestation is done, return the attested Power of Attorney deed to Bangladesh. Please remember the attested POA has a 90 day time bar to submit it before the Ministry of Foreign Affairs, Dhaka.

Use DHL/FedEx to send the attested document to your appointed property lawyer in Bangladesh. Keep the tracking ID and memo for future reference.

5. Post attestation formalities in Bangladesh

After attestation by the Embassy of Bangladesh, such Power of Attorney is required by law to be cross-verified by the Ministry of Foreign Affairs. Generally, it takes 10–15 days for ministry approval. Immediately after ministry approval, the approved POA shall need to be submitted before the District Commissioner of the concerned district where the land is situated.

The District Commissioner, on receipt of such application, shall forward it to the concerned AC Land office and Tahsil office to check if any government interest or case is involved with the scheduled land.

If the AC Land finds no issues, he will submit a report to the District Commissioner. The Commissioner then shall ask to pay the prescribed government fees and stamp duties associated with it.

After stamping, the District Commissioner shall forward the file to the concerned Sub-Registrar with approval for registering the Power of Attorney deed.

6. Registration at Sub Registry Office

The Power of Attorney once stamped and approved by the District Commissioner, will reach the Sub-Registry Office within 3–5 days. It is advisable to register the Power of Attorney deed immediately upon its arrival at the Sub-Registry Office. On the day of registration, the attorney in Bangladesh must be physically present at the Sub-Registry Office with all original documents, including NID, photographs, and other required papers.

In the case of a foreign Power of Attorney, an additional affidavit (signed by the attorney) must be attached along with the attested Power of Attorney.
